Not making an argument for it, but technically they’re using the exception to the amendment. Most states, including California, have it in their state amendments, so unless they put in another Federal amendment it’s going to remain this way.

If I’m following news properly, these are probably the juveniles who were taken from their holding facility to fight fires. They are not compensated for this work, but are placed in harm’s way.

If you’re going to do this, use blanks or shotgun with birdshot. That way you’re not raining lead on some unsuspecting person a mile or so away and birdshot is just small bbs that don’t have a high terminal velocity.
